Service Agreement
Version 2026-09-19
These are the terms every Pumpkin'd booking is made under. The version in force on the day you paid is the version that governs your booking, and it is recorded against your order. Please read the acknowledgements: they are the parts people are most surprised by later, and ticking the box at booking means you accept them.
What you are agreeing to
These six are the ones worth your attention. A pumpkin display is heavy, wet, alive and sitting on your steps for weeks, and the consequences of that are yours. You accept these when you book.
1. The display is yours once it is installed
- 1.1Ownership of the pumpkins and every other item in the display passes to you when the installation is finished. From that moment the display, and everything that happens to it or because of it, is your responsibility.
- 1.2We do not maintain, monitor, tend, water, rotate, clean or replace any part of a display after installation. Our service is the display as installed on the day. Nothing in our materials should be read as a promise of ongoing care.
- 1.3If you have bought end-of-season removal, we return once, in November, to collect and dispose of the display. That single visit is the only return visit included in any price.
2. Pumpkins mark, stain and damage the surfaces they sit on
- 2.1Pumpkins are heavy, wet, living produce. Left in place for weeks they hold moisture against whatever is beneath them and release tannins, sap and plant matter as they age. This routinely stains, marks, bleaches, discolours, etches, scratches, dents or leaves rings on wood, paint, stain, sealant, composite and PVC decking, stone, brick, concrete, tile, masonry, carpet, doormats, artificial turf and metal.
- 2.2You accept that this is an ordinary and expected consequence of a pumpkin display, not a defect and not damage caused by us. We are not responsible for staining, marking or deterioration of any surface arising from the presence, weight, moisture or decomposition of the display.
- 2.3You are responsible for deciding that your surfaces can carry a display. If a surface is new, freshly painted, freshly sealed, delicate, porous, antique or otherwise a concern, tell us before installation and place protection beneath the display yourself, or ask us to site it elsewhere.
- 2.4This is the single most common source of disappointment in this trade, and it is why it is written this plainly.
3. A display on steps is an obstruction, and you are responsible for safe passage
- 3.1Displays are installed on steps, stoops, landings, walkways, railings and porches. They narrow those surfaces, they can be moved by wind, animals or people, and they can be difficult to see at night.
- 3.2Once installation is finished, you are solely responsible for the safety of everyone who comes to your property, including making sure entrances, exits, steps and walkways remain safe to use, adequately lit, and passable, and for any obligations you have under law as the occupier of the property.
- 3.3You accept the risk of trips, slips, falls, collisions and obstruction arising from the display after installation, and you will not hold us responsible for them.
- 3.4If any part of a display blocks a doorway, a handrail, a step, a ramp, a meter, a vent or an exit in a way that concerns you, move it or tell us and we will move it.
4. Pumpkins attract wildlife and pests, and they rot
- 4.1Pumpkins are food to squirrels, chipmunks, mice, rats, deer, raccoons, groundhogs, birds, flies, ants, wasps and slugs. A display outdoors will attract animals and insects, and they may gnaw, break, move, hollow, soil or carry away parts of it.
- 4.2Every pumpkin decays. Depending on the weather, the season and luck, a display may soften, weep, collapse, grow mould, smell, leak or attract flies well before the season ends. This can happen within days and is outside anybody's control.
- 4.3You accept that wildlife interest, pest activity, decomposition, odour, leakage, mould and mess are normal and expected, are not defects, and are not our responsibility. We give no guarantee, express or implied, as to how long any pumpkin or display will last or how it will look as it ages.
- 4.4We are not responsible for any animal or insect activity at your property, for any damage those animals or insects cause, or for any pest treatment you choose to arrange.
5. Children, pets and the things a display can become
- 5.1A pumpkin is heavy enough to hurt someone if it falls or is pulled down, and stacked arrangements can topple if climbed on, leaned on or knocked.
- 5.2You are responsible for supervising children, pets and visitors around the display, and for keeping it away from anyone who might be harmed by it.
- 5.3Pumpkins in a display are decorative and are not supplied as food. They are chosen for appearance and weathering, are not washed, stored or handled as produce, and sit outdoors for weeks. Do not eat them, cook with them or feed them to animals.
6. The property is yours to decorate
- 6.1You confirm that you own the property, or that you are authorised by the owner to have a display installed on it, and that you may lawfully enter into this agreement.
- 6.2You are responsible for making sure the display complies with any homeowners' association rule, condominium bylaw, lease, deed restriction, municipal ordinance or permit requirement that applies to your property. We do not check these and take no responsibility for them.
- 6.3If a display has to be removed or altered because of any such rule, that is not a fault in our work and no refund is due.
- 6.4You confirm the installation area is safe to work in and free of hazards you know of, and that we may enter the property on the agreed day for as long as the installation takes.
The rest of the agreement
7. Who this agreement is between
- 7.1This agreement is between you, the customer, and Pumpkin'd, of Manahawkin, New Jersey ("we", "us", "our"). It is formed when you complete a booking and pay a deposit, and it covers that booking.
- 7.2It replaces anything said beforehand, in conversation, by email or on any other page of this site. If we agree something different in writing for your booking, that writing controls for that booking only.
8. What we do
- 8.1We design a seasonal pumpkin display for your property, select and buy the pumpkins, deliver them, and arrange and install the display on your porch or entry. Design and styling are included in every price.
- 8.2Which varieties, sizes, colors and quantities make up your display is our decision, made in the week of your installation from what the farms actually have. Published contents are a guide to the character and scale of a display, not a promise of specific pumpkins or exact counts. If something is unavailable we substitute something comparable.
- 8.3We do not carve pumpkins, and no display includes carved pumpkins.
9. Prices, deposit and balance
- 9.1Each display has one all-inclusive price covering the pumpkins, design and styling, delivery and installation. The price you approve is the price you pay; nothing is added afterward except charges set out in this agreement.
- 9.2A deposit of half the total is due to reserve your installation week. The remaining balance is due before your installation day. We are not obliged to install a display whose balance has not been paid.
- 9.3Payments are taken by card through Stripe. We never see or hold your card details.
- 9.4Where a display is quoted individually, the figure we give you in writing is the price, and you approve it before anything is ordered.
10. Scheduling and access
- 10.1You book an installation week, not a day. We confirm the exact day within that week and tell you by email once it is set.
- 10.2We install a limited number of displays each week. A week is held for you when your deposit is paid and closes when it is full.
- 10.3You do not need to be home. You do need to give us access to the installation area on the day, and to have removed anything you do not want us to work around.
- 10.4Weather, farm supply, illness, vehicle failure and other things outside our control can move an installation. If that happens we will tell you and offer the next workable day. A delay of this kind is not a breach of this agreement, and we are not liable for any cost or loss caused by it.
- 10.5If we cannot reach the installation area on the agreed day for a reason on your side, including a locked gate, an obstruction, an unsafe area or an animal we cannot work around, we may treat that day as used and charge a further trip to return.
11. Changing or cancelling a booking
- 11.1Tell us as early as you can. Before the pumpkins for your week have been bought, you may cancel for a full refund of everything you have paid.
- 11.2We buy each week's pumpkins on a single farm run on the Saturday before that installation week. Once that run has happened your pumpkins have been chosen, bought and paid for, and they cannot be sold to anyone else. From that point the deposit is non-refundable, and if the balance has been paid we will refund it less the deposit.
- 11.3You may move your installation to another week with availability at no charge, provided you ask before that Saturday farm run. After it, moving means a second set of pumpkins, and the deposit is forfeited.
- 11.4We may decline or cancel a booking, for example where a property is unsuitable, unsafe or outside our area, or where we cannot source what a display needs. If we cancel for a reason that is not your fault, you get a full refund of everything you have paid, and that refund is the whole of our responsibility to you.
- 11.5Refunds go back to the card that paid, and can take several working days to appear.
12. End-of-season removal
- 12.1Removal is an optional add-on chosen when you book. If you have bought it, we return once in November, collect the display and dispose of it.
- 12.2If you have not bought it, disposal is yours to arrange. Pumpkins are compostable and most towns accept them with yard waste.
- 12.3We will not enter a property to remove a display without the customer having bought removal, and we are not responsible for a display left in place after the season.
13. Photographs
- 13.1We may photograph and film displays we install, and use those images to show our work, including on this site, in advertising and on social media.
- 13.2We will not publish your street address, house number or name alongside an image, and we will not identify you as a customer without asking you first.
- 13.3If you would rather we did not photograph your display at all, tell us before your installation day and we will not.
14. What we are responsible for, and what we are not
- 14.1We take reasonable care while working at your property, and we are responsible for physical damage we cause to your property through our own negligence during installation or removal. Tell us within seven days of the visit so we can look at it and put it right.
- 14.2We are not responsible for anything covered by the acknowledgements above, including surface staining and marking, trips and falls after installation, wildlife and pests, decay, odour or mess, or any consequence of the display existing on your property.
- 14.3We are not responsible for indirect or consequential losses of any kind, including lost enjoyment, event disruption, the cost of a replacement display, or damage to reputation.
- 14.4Except where the law does not allow it to be limited, our total responsibility to you for any claim connected with a booking, however it arises, will not exceed the total amount you have actually paid us for that booking.
- 14.5Nothing in this agreement limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If any part of this agreement is found unenforceable, the rest continues to apply.
- 14.6You agree to reimburse us for any claim, loss or cost we suffer because you did not have the authority to have the display installed, or because of a breach by you of this agreement.
15. Law, and how to raise a problem
- 15.1This agreement is governed by the law of the State of New Jersey, and any dispute belongs in the courts of Ocean County, New Jersey.
- 15.2Before anything else, call or email us. We are two people in Manahawkin, and nearly everything is fixed with a phone call.
Anything here unclear, ask before you book, not after: katelynspinozzi@gmail.com or (609) 891-8228.
